OVERVIEW

PACEHABIT ("PACEHABIT," "we," "us," or "our") operates pacehabitclub.com and its related content, products, features, tools, and services (collectively, the "Services").

Our online store is hosted by Shopify, which provides the e-commerce platform used to offer and sell our products.

These Terms of Service ("Terms") govern your access to and use of the Services. By visiting our website, creating an account, or placing an order, you agree to these Terms and our Privacy Policy:

If you do not agree to these Terms, please do not access or use the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNTS

By using the Services, you confirm that you are at least the age of majority in your state of residence or that you have permission from a parent or legal guardian.

You agree to provide accurate, complete, and current account, billing, payment, and shipping information.

You are responsible for maintaining the security of your account credentials and for activity performed through your account. Accounts must not be sold, transferred, assigned, or licensed to another person.

SECTION 2 — PRODUCTS

PACEHABIT products are produced through a print-on-demand fulfillment process and are manufactured after an order is submitted for production.

We make reasonable efforts to display product descriptions, colors, designs, sizing, artwork placement, and images accurately. Screen settings, garment batches, manufacturing processes, and print methods might result in minor differences in color, dimensions, texture, or print placement.

Product images include digital mockups and lifestyle presentations intended to represent the product and design. They are not guarantees of exact physical color or placement.

Product descriptions, prices, designs, sizes, and availability are subject to change without prior notice. PACEHABIT reserves the right to discontinue products or limit quantities.

SECTION 3 — ORDERS

Submitting an order constitutes an offer to purchase.

An order is accepted after payment is authorized and an order confirmation is issued.

PACEHABIT reserves the right to reject or cancel an order involving:

  • Suspected fraud or unauthorized payment

  • Incorrect pricing or product information

  • Product or material unavailability

  • Shipping restrictions

  • Violation of these Terms

  • Technical or fulfillment errors

If an accepted order is canceled by PACEHABIT, the amount paid for the canceled item will be refunded.

Customers should review product selection, size, color, quantity, and shipping information before placing an order. Production begins shortly after purchase, so changes or cancellations are not guaranteed after submission.

Products are sold for personal or household use unless PACEHABIT provides written approval for resale.

SECTION 4 — PRICES, PAYMENTS, AND PROMOTIONS

Prices are displayed in United States dollars unless the store displays another currency.

The price charged is the price displayed when the order is submitted, subject to correction of pricing or technical errors.

Shipping charges and applicable taxes are displayed during checkout.

Customers agree to provide accurate payment information and confirm that they are authorized to use the selected payment method.

Discount codes and automatic promotions:

  • Apply only during the stated promotional period

  • Are subject to stated eligibility requirements

  • Have no cash value

  • Must not be sold or transferred

  • Might be limited to one use or one customer

  • Do not combine unless checkout expressly allows combination

PACEHABIT reserves the right to modify, suspend, reject, or end a promotion involving misuse, fraud, technical errors, or eligibility violations.

SECTION 5 — SHIPPING AND DELIVERY

PACEHABIT currently ships eligible orders within the United States.

Products require production time before shipment. Transit estimates begin after production is complete.

Delivery dates and checkout estimates are estimates and are not guaranteed.

Carrier delays, severe weather, address errors, service interruptions, high-volume periods, and other events outside our reasonable control might affect delivery.

Customers are responsible for providing a complete and accurate shipping address.

Additional charges resulting from an incorrect or incomplete address are the customer's responsibility.

SECTION 6 — RETURNS, REPLACEMENTS, AND REFUNDS

PACEHABIT products are made to order.

Returns or exchanges for the following reasons are not accepted:

  • Wrong size selected by the customer

  • Wrong color selected by the customer

  • Change of mind

  • Buyer's remorse

Damaged, defective, misprinted, or incorrect products should be reported within 30 days of delivery with the order number and clear photographic evidence.

Nothing in these Terms limits consumer rights that applicable law does not permit a business to waive.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their content, including trademarks, logos, product designs, artwork, text, graphics, photographs, videos, page layouts, and branding, belong to PACEHABIT, its licensors, or applicable rights holders.

The PACEHABIT name, logo, slogans, and original designs must not be copied, reproduced, modified, distributed, sold, displayed, or used for commercial purposes without prior written permission.

Personal, non-commercial access to the Services does not grant ownership or a license to PACEHABIT intellectual property.

Shopify names, trademarks, and technology belong to Shopify or its affiliates. Other third-party marks belong to their respective owners.

SECTION 8 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

The Services include tools or services provided by Shopify, including Shopify Email, Shopify Forms, Shopify Inbox, and AI-assisted customer-support features; Printify and participating print providers; payment providers; shipping carriers; and other service providers used to operate the store.

Third-party services operate according to their own terms and privacy notices.

PACEHABIT does not control the independent operation, availability, or security of third-party platforms.

SECTION 9 — THIRD-PARTY LINKS

The Services might contain links to third-party websites and social-media platforms.

PACEHABIT does not control and is not responsible for the content, products, privacy practices, security, accuracy, or availability of third-party websites.

Customers should review the applicable third-party terms and privacy policies before submitting information or completing transactions outside pacehabitclub.com.

SECTION 10 — RELATIONSHIP WITH SHOPIFY

PACEHABIT is powered by Shopify, which supplies the e-commerce platform used to provide the Services.

All product sales are transactions directly between the customer and PACEHABIT.

Shopify is not the seller of PACEHABIT products and is not responsible for product quality, production, fulfillment, injury, loss, or damage related to a PACEHABIT purchase.

SECTION 12 — CUSTOMER CONTENT AND FEEDBACK

If you submit reviews, photographs, feedback, suggestions, or other content, you confirm that:

  • You own the content or hold the required permissions

  • Any incentive or compensation has been disclosed

  • The content does not violate applicable law or another person's rights

  • The content does not contain malicious software

You grant PACEHABIT a non-exclusive, worldwide, royalty-free license to reproduce, publish, display, modify, and use submitted content for operating, improving, and promoting the Services.

PACEHABIT reserves the right to remove unlawful, misleading, abusive, infringing, obscene, or otherwise inappropriate content.

SECTION 13 — ERRORS AND INACCURACIES

Product descriptions, prices, discounts, shipping costs, availability, transit estimates, and other store information might occasionally contain errors or omissions.

PACEHABIT reserves the right to correct information, update content, reject an order, or cancel an affected order.

If payment was collected for an order canceled because of an error, the applicable amount will be refunded.

SECTION 14 — PROHIBITED USES

You must not use the Services to:

  • Violate applicable law

  • Commit fraud or submit false information

  • Infringe intellectual-property, privacy, or other legal rights

  • Harass, threaten, abuse, or impersonate another person

  • Circumvent access controls or security protections

  • Interfere with store operation or another customer's access

  • Place orders using stolen or unauthorized payment information

PACEHABIT reserves the right to restrict or terminate access involving prohibited conduct.

SECTION 15 — AUTOMATED SYSTEMS

Automated or semi-automated systems accessing the Services must comply with applicable law, published instructions, and technical restrictions.

Automated systems must not:

  • Impersonate a human user

  • Conceal automated access

  • Bypass CAPTCHAs or access controls

  • Evade traffic restrictions

  • Interfere with website security or operation

PACEHABIT reserves the right to block or limit automated access.

SECTION 16 — TERMINATION

PACEHABIT reserves the right to suspend or terminate access to the Services following fraud, abuse, security threats, prohibited conduct, or violations of these Terms.

Amounts lawfully owed before termination remain payable.

Provisions relating to intellectual property, privacy, disclaimers, liability, indemnification, governing law, and other provisions intended to survive termination will continue after termination.

SECTION 17 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and products are provided on an "as available" and "as is" basis except for warranties expressly stated by PACEHABIT or required by law.

PACEHABIT does not guarantee uninterrupted website access, error-free operation, or specific results from reliance on general website information.

Legal rights and warranties that applicable law does not permit a business to exclude remain unaffected.

SECTION 18 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, PACEHABIT, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers are not liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products.

Where applicable law does not permit a limitation or exclusion, liability is limited only to the extent permitted by law.

Nothing in these Terms excludes liability that applicable law does not permit a business to exclude.

SECTION 19 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless PACEHABIT, Shopify, and their respective affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, damages, losses, and reasonable legal expenses arising from:

  • Your violation of these Terms

  • Your violation of applicable law

  • Your infringement of another person's rights

  • Your misuse of the Services

This obligation does not apply where prohibited by applicable law.

SECTION 20 — SEVERABILITY

If any provision of these Terms is found invalid, unlawful, or unenforceable, the affected provision will be limited or removed to the minimum extent required.

The remaining provisions will continue in effect.

SECTION 21 — WAIVER AND ENTIRE AGREEMENT

Failure to enforce any provision does not waive the right to enforce it later.

These Terms and the policies incorporated by reference form the entire agreement governing use of the Services and replace earlier agreements regarding the same subject.

SECTION 22 — ASSIGNMENT

You must not assign or transfer your rights or obligations under these Terms without prior written consent from PACEHABIT.

PACEHABIT reserves the right to assign its rights and obligations as part of a business transfer, restructuring, merger, acquisition, or sale, subject to applicable law.

SECTION 23 — GOVERNING LAW

These Terms and disputes relating to the Services are governed by the laws of the State of New York and applicable federal laws of the United States, without regard to conflict-of-law principles.

Venue and jurisdiction will lie in the applicable state or federal courts serving the jurisdiction in New York where PACEHABIT operates, except where applicable consumer law requires a different forum.

SECTION 24 — CHANGES TO THESE TERMS

PACEHABIT reserves the right to update these Terms to reflect operational, legal, regulatory, or service changes.

The revised Terms will be posted with an updated revision date.

Material changes will receive notice where required by applicable law.

Continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms.
